Welcome to pianoreading.com and Measure by Measure
These Terms of Service (\"Terms\") govern your access to and use of the Measure by Measure membership program and the pianoreading.com site (\"Service\") provided by Stearns LLC (\"we,\" \"us,\" or \"our\"), operating under the name Piano Reading. By accessing or using the Service, you agree to be bound by these Terms.
We may modify these Terms at any time, and continued use of the Service indicates acceptance of the changes. The “last updated” date of these Terms will indicate when a change was made. We will make reasonable efforts to announce any changes, but it is your responsibility to review these terms periodically to be made aware of the changes

1. Membership Overview
Measure by Measure is a subscription-based piano education membership. Upon registration and payment, members receive access to educational materials, and optional feedback opportunities. Your subscription will automatically renew at the selected billing interval until canceled.

2. Eligibility and User Representations
By using the Service, you represent and warrant that:
- You are at least 13 years old.
- If under 18, you have parental or guardian permission.
- All registration information is accurate.
- You will use the Service in accordance with all applicable laws.

3. Account Registration and Use
You agree to:
- Maintain accurate and updated registration information.
- Keep your password confidential.
- Use your account only for personal learning.
- Not share your account with others.
We reserve the right to revoke access or terminate accounts at our discretion for any reason.

4. Payment and Billing
Subscriptions are billed on a recurring basis (monthly or annually, as selected).
Payments are processed through Payments.AI, Stripe, Apple Pay, or PayPal depending on which method you selected on the checkout page.
Your payment method will be charged automatically at the interval selected (monthly or annually) at checkout until you cancel.
You may cancel any time via your account dashboard.
We do not offer refunds for prior billing periods.
We do not offer refunds for unused time within a billing cycle.
For example, if you cancel your annual membership six months into the year, you will retain access for the remaining six months, but no prorated refund will be issued.
If a trial period is offered, it will convert to a paid membership unless canceled before the trial ends.
By purchasing a membership, you agree not to initiate a dispute or chargeback without first contacting us to resolve any issue.
Accessing the membership site or lesson materials constitutes use of the service. However, failure to log in or engage with the materials does not exempt you from payment obligations or justify a chargeback. Your payment grants access to a digital service, and that access is established upon successful transaction—regardless of whether you choose to use it.
In the event of an improper chargeback, we reserve the right to dispute the claim with evidence of your agreement to these Terms, confirmation of purchase, and system records showing availability of content. Chargebacks that result in financial loss may lead to permanent termination of access and account privileges.

5. Access to Content
You are granted a limited, non-exclusive, non-transferable license to access course content for your personal, non-commercial use only, for the duration of your active membership.
Video content is strictly streaming-only and may not be downloaded, saved, copied, or redistributed in any form.
PDF resources and other downloadable materials are provided solely for your individual educational use. These may be downloaded via the provided "get" or "download" buttons within the membership site. However, all such materials remain the intellectual property of Stearns LLC.
You may not share, upload, publish, distribute, reproduce, or repurpose any PDF, worksheet, lesson content, or associated materials on social media, websites, online forums, file-sharing platforms, or any other public or private medium.
Any attempt to use the content in your own teaching, business, or commercial enterprise without explicit written permission is a violation of these Terms and may result in immediate termination of access and legal action.
Access to content ends upon membership cancellation, unless otherwise noted.

6. Intellectual Property Rights
All materials provided in the Service—including videos, lesson content, branding, PDFs, and sheet music—are the intellectual property of Stearns LLC and are protected under applicable copyright, trademark, and other laws.
While some of the sheet music used within the Service is based on works in the public domain, the custom engraving, formatting, fingering, markups, annotations, and all instructional additions made by Stearns LLC are original works and remain our exclusive intellectual property. These materials may not be copied, reproduced, distributed, or used in any other context—commercial or educational—without our express written permission.
Your membership grants you a limited, personal license to use these materials solely within the context of your individual piano learning. Redistribution, republishing, or repurposing of any content for use in your own business or teaching is strictly prohibited.

7. Submitted Materials for Promotional Use
Members may submit videos, testimonials, or other content as part of their participation in the program. By submitting any material, you grant Stearns LLC a royalty-free, worldwide, perpetual, and non-exclusive license to use, reproduce, display, edit, and distribute these materials for both instructional and promotional purposes.
This may include—but is not limited to—using excerpts from your submissions in advertisements, email campaigns, social media content, sales pages, or other marketing materials. We will always use discretion and professionalism in how these materials are presented.
If you prefer not to have your content used for promotional purposes, you must notify us in writing. We will honor such requests when made in advance of any promotional use.

7.5 Feedback Submissions and Instructor Interaction
As part of your membership, you may have the opportunity to submit videos, questions, or practice updates for educational feedback. While we enjoy engaging with members and providing guidance whenever possible, individual feedback is not guaranteed and should be considered a bonus—not a core feature—of your membership.
At this time, Measure by Measure is operated by a single instructor, and while every effort is made to respond thoughtfully and regularly, response times and availability may vary depending on volume, schedule, and other commitments.
We encourage participation and submission, and appreciate your understanding that instructor interaction is offered as a courtesy and subject to availability, not as a promised deliverable.

8. Community Participation Guidelines
Participation in any community feature of the Service (including private forums, messaging spaces, or discussion boards) is a privilege, not a right. You are expected to conduct yourself in a respectful, lawful, and non-disruptive manner at all times. Stearns LLC reserves the right, at our sole discretion and without prior notice, to monitor, moderate, remove, restrict, or permanently revoke access to any community feature for any reason, including but not limited to:
Harassment, abuse, or intimidation of any other user or staff member.
Use of hate speech, offensive language, or discriminatory remarks.
Posting spam, solicitations, or unauthorized promotional content.
Attempting to undermine the integrity, safety, or value of the community.
Offering unsolicited instruction, coaching, or critique to other members in a way that circumvents or contradicts the role of the program’s instructor.
Violations of this policy may result in immediate removal of content, suspension, or permanent ban from the community and/or the membership program. No refund will be issued in the event of termination due to behavior that violates these community guidelines.

9. Prohibited Conduct
You agree not to:
- Violate any law or regulation.
- Access the site using bots, scrapers, or automated methods.
- Share content without authorization.
- Use the Service to advertise or compete.
- Upload viruses, malware, or attempt to interfere with the site’s functionality.

10. Technology and Availability
We strive to ensure reliable access but make no guarantees of uninterrupted service. Technical issues may occur due to internet connections, updates, or external factors.

11. Termination of Access
We reserve the right to terminate or suspend your access without notice for violations of these Terms. Upon termination, your right to access the Service and its content ends immediately.

12. Privacy
Use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein, including email communications.

13. Disclaimers
The Service is provided \"as is\" without warranties of any kind. We do not guarantee specific results from your participation. We disclaim liability for interruptions, data loss, or technical errors.

14. Physical Activity and Personal Results
Piano playing, like any physical activity, carries a small risk of strain or discomfort to the hands, fingers, wrists, arms, shoulders, neck, or back. By participating in this program, you agree that you are responsible for your own well-being and physical limits. We encourage all members to use proper technique, take regular breaks, and consult a medical professional if you experience any discomfort.
Additionally, while this program is designed to support and inspire your progress, every individual learns at a different pace and results may vary. By enrolling, you acknowledge that your success depends on many factors—including effort, consistency, and personal aptitude—and that we cannot guarantee specific outcomes.
By participating in Measure by Measure or other educational material from pianoreading.com, you agree to waive any claims against Stearns LLC related to physical injury or dissatisfaction with your personal learning progress or experience.

15. Limitation of Liability
To the fullest extent permitted by law, Stearns LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

16. Indemnification
You agree to indemnify and hold harmless Stearns LLC and its employees from any claims, losses, or liabilities arising from your use of the Service or your breach of these Terms.

17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington. Any dispute will first be addressed through informal negotiation. If unresolved, it will be submitted to binding arbitration in King County, Washington.

18. Modifications to the Service
We may change, update, or discontinue parts of the Service at any time. We are not liable for changes in availability or features.
